1. Definitions and Interpretation
In these Terms, unless the context requires otherwise, the following terms shall have the meanings set out below:
Member | An individual who has entered into a Membership with the Academy. |
Membership | A contract for access to the Facility and services as set out in these Terms, including any coaching services. |
Academy/Facility | SwingFIT Academies golf simulator facility located at Gate Avenue, Zone D, Trade Centre, DIFC, or at Community Building 4, Ground Floor, Dubai Studio City, UAE, or any other locations operated by the Academy from time to time. |
Billing Cycle | A calendar month from the same date each month (e.g., 13th to 12th of the following month). |
Commitment Term | A period of twelve (12) consecutive months from the Commencement Date, during which the Member is obligated to pay the monthly fee. |
Monthly Fee | The recurring monthly charge for the Membership tier selected by the Member, payable in advance on the same date each month. |
Coaching Add-On | Optional coaching packages purchased separately by Members, consisting of lessons with a PGA or Senior PGA Coach. |
Booking | A reservation made by a Member to use a simulator session at a specified date and time. |
Pause Period | A period during which a Member temporarily suspends their Membership, during which no fees are charged and no access to the Facility is permitted. |
Early Termination | The cancellation of a 12-month Commitment Term by the Member before the expiry of the full 12 months. |
Written Notice | Communication sent by email to info@swingfitacademies.com, cancellations@swingfitacademies.com, or delivered in person at the Facility. |
Commencement Date | The date on which the Member’s Membership becomes active and fees commence. |
Guest | A person other than the Member who is invited by the Member to use the Facility under the Member’s supervision. |
2. Membership Categories and Fees
2.1 Membership Tiers
The Academy offers four (4) membership tiers, each with distinct benefits and pricing:

2.2 Pricing and VAT
All Membership fees are quoted in United Arab Emirates Dirhams (AED) and are inclusive of applicable Value Added Tax (VAT) unless otherwise stated in writing by the Academy.
2.3 Fee Adjustment
The Academy reserves the right to adjust Membership fees upon reasonable written notice of not less than thirty (30) calendar days. Any fee adjustment shall take effect at the start of the next Billing Cycle following the expiry of the notice period. Fee adjustments shall not apply retroactively to existing Commitment Terms unless the adjustment is expressly agreed in writing by the Member.
3. Commitment Term and Month-to-Month Memberships
3.1 12-Month Commitment
Upon making the first payment for a Membership tier that includes a 12-month commitment (Tiers 1, 3, and 4), the Member is legally committed to the full 12-month Commitment Term. Monthly fees shall be billed automatically on the same date each month throughout the Commitment Term. The Member acknowledges that this is a binding financial commitment.
3.2 Month-to-Month Membership
Month-to-Month Memberships are available for select tiers at the Academy’s sole discretion. Month-to-Month Memberships carry no minimum commitment beyond the current Billing Cycle. Cancellation requires thirty (30) calendar days’ written notice. Facility access shall continue until the end of the notice period, after which the Membership shall terminate automatically.
3.3 Automatic Conversion After Commitment Term Expiry
Upon expiry of the 12-month Commitment Term, the Membership shall automatically convert to a month-to-month rolling membership at the then-prevailing monthly rate for Month-to-Month Memberships, unless the Member elects to renew for a further 12-month Commitment Term or provides written notice of cancellation at least thirty (30) calendar days prior to the expiry date of the Commitment Term.
4. Billing and Payment
4.1 Automatic Monthly Billing
The Member’s monthly Membership fee shall be charged automatically via the payment method on file at the same date each month. The Member authorises the Academy to charge this payment method for all fees due under this Agreement.
4.2 Member’s Payment Responsibility
The Member is solely responsible for maintaining valid and current payment details with the Academy. The Member shall notify the Academy immediately of any changes to their payment method.
4.3 Failed Payments
If a payment fails for any reason, the Academy will attempt to collect the outstanding amount. If payment remains outstanding for seven (7) consecutive calendar days, the Academy may suspend the Member’s access to the Facility. Suspended Memberships may be reactivated only upon payment in full of all outstanding amounts. All outstanding fees remain due and payable regardless of any suspension.
4.4 No Refunds for Partial Months
No refunds or credits shall be issued for Membership fees paid for a partial calendar month or Billing Cycle. All payments for a Membership fee are non-refundable once the Billing Cycle has commenced, except as may be required by applicable law or as expressly set out in these Terms.
5. Booking Policy and Usage Rules
5.1 Maximum Active Bookings
CRITICAL: Each Member is entitled to hold a maximum of one (1) active booking at any given time. A new booking may only be made once the existing booking has been completed, cancelled, or has elapsed. This policy ensures equitable access to Facility resources for all Members.
5.2 Daily Booking Limit
Each Member is limited to one (1) practice or play session per calendar day. Sessions are personal use only and may not be transferred or delegated to another individual.
5.3 Availability and Fair Use
Unlimited practice and play sessions are subject to availability and the Academy’s booking system. The Academy reserves the right to implement fair-use policies and restrictions to ensure equitable access for all Members, particularly during peak hours.
5.4 Non-Transferable Membership Access
Membership access credentials and benefits are personal to the Member and may not be shared, transferred, or used by any other person. The Member is responsible for maintaining the confidentiality of all access credentials.
6. Coaching Lessons
6.1 Included Monthly Lessons (Tiers 3 and 4)
For Members with Tier 3 or Tier 4 Memberships, the specified number of monthly coached lessons (1 to 4, as selected and fixed at enrolment) are included in the monthly fee. These lessons must be utilised within the Billing Cycle in which they are credited. Unused lessons DO NOT roll over to subsequent months and are forfeited at the end of each Billing Cycle.
6.2 Coaching Add-On Lesson Packs (Tier 2)
Coaching Add-On lesson packs purchased by Tier 2 Members (or any Member wishing to purchase additional lessons) are available in packs of 4, 8, or 12 lessons at 350 AED per lesson (PGA Coach) or 550 AED per lesson (Senior PGA Coach). These lesson packs expire 12 months from the date of purchase and are strictly non-transferable and non-refundable. Any unused lessons remaining after the expiry date shall be forfeited automatically with no compensation.
6.3 Coach Assignment and Substitution
All coaching is delivered by SwingFIT Academy coaches. The Academy shall assign coaches to Members based on availability, expertise, and coaching capacity. The Member’s Membership is with the Academy as an institution, not with any individual coach. The Academy may substitute coaches at its sole discretion with reasonable notice to the Member.
7. Cancellation and Early Termination
7.1 Cancellation of Month-to-Month Memberships
- Cancellation of a Month-to-Month Membership requires thirty (30) calendar days’ written notice to the Academy.
- Facility access shall continue throughout the notice period and shall terminate automatically on the last day of the 30-day notice period.
- Written notice must be submitted via email to cancellations@swingfitacademies.com or info@swingfitacademies.com, or delivered in person at the Facility.
7.2 Early Termination of 12-Month Commitment
A Member may terminate a 12-month Commitment Term before the expiry date by providing written notice to the Academy. Upon early termination, the Member shall pay an Early Termination Fee calculated as set out below:
- More than three (3) months remaining on the Commitment Term: The Early Termination Fee shall equal three (3) months of the Member’s then-current Monthly Fee.
- Three (3) months or fewer remaining on the Commitment Term: The Early Termination Fee shall equal the total Monthly Fees for all remaining months of the Commitment Term.
The Early Termination Fee represents a genuine pre-estimate of the loss and damage that the Academy will suffer as a result of early termination, including but not limited to: the discounted membership rate provided in consideration of the Member’s commitment to the 12-month term, administrative costs associated with membership processing and termination, and disruption to scheduling and resource allocation. The parties acknowledge that such fee is reasonable and proportionate to the anticipated loss.
Facility access shall cease on the date the Academy receives the written notice of early termination. The Early Termination Fee is due and payable within fourteen (14) calendar days of the termination notice, and shall be deducted from any refunds due or added to any outstanding balance owing by the Member.
7.3 Termination by the Academy for Cause
The Academy may terminate a Membership immediately and without notice for material breach by the Member, including but not limited to:
- Non-payment of fees for more than seven (7) consecutive days
- Serious or repeated misconduct by the Member or their guests
- Damage to Academy property or equipment
- Violation of these Terms or Facility rules
- Abusive, threatening, or discriminatory behaviour
In the event of termination for cause, no refund of fees shall be due. Any outstanding fees remain payable in full.
8. Membership Pause (Freeze)
8.1 Availability
Membership pauses are available exclusively to Members with a 12-month Commitment Term. Month-to-Month Members may terminate instead of pausing.
8.2 Pause Parameters
Each Member may request one (1) pause per membership year, subject to the following conditions:
- Minimum duration: two (2) consecutive calendar weeks
- Maximum duration: eight (8) consecutive calendar weeks
- Must be requested in writing at least seven (7) calendar days before the desired pause start date
8.3 Pause Effects
During a Pause Period:
- No billing shall occur; the Member shall not be charged the monthly fee
- No access to the Facility is permitted
- No coaching sessions are available
- The Commitment Term shall be automatically extended by the duration of the Pause Period, so that the Member’s commitment extends beyond the original 12-month period
8.4 Medical Pauses
Medical pauses supported by valid medical documentation from a licensed healthcare professional are available, subject to the Academy’s prior written approval. Medical pauses are subject to a maximum of eight (8) consecutive weeks per 12-month membership period (inclusive of any standard pause taken during the same period). The Academy shall not unreasonably withhold approval for medically necessary pauses.
9. Membership Upgrades and Downgrades
9.1 Upgrades During Commitment Term
A Member may upgrade to a higher-tier Membership at any time during the Commitment Term. The upgraded monthly fee shall take effect from the start of the next Billing Cycle. The Member’s original 12-month Commitment Term continues from the original Commencement Date and does not restart upon upgrade.
9.2 Downgrades
Downgrades to a lower-tier Membership are NOT permitted during the initial 12-month Commitment Term. After the Commitment Term expires and the Membership converts to month-to-month, downgrades may be requested with thirty (30) calendar days’ written notice. The downgraded tier and monthly fee shall take effect at the start of the next Billing Cycle.
10. Guest Policy
10.1 Guest Access
Members may bring guests to use the Facility for play sessions at no additional charge. Guests are not permitted to access coaching sessions unless specifically arranged and paid for separately.
10.2 Guest Registration
All guests must be registered with the Academy reception prior to their first use of the Facility. Guest details must include name, contact information, and relationship to the Member.
10.3 Member Responsibility
The Member is fully responsible for the conduct of their guests and for any damage caused to Academy property or equipment by their guests. The Member shall ensure that guests comply with all Facility rules and these Terms.
10.4 Availability and Restrictions
Guest access is subject to Facility availability and may be limited during peak hours. The Academy reserves the right to restrict guest privileges with reasonable notice to the Member if abuse of the guest policy is detected.
11. Cooling-Off Period
In accordance with UAE consumer protection principles and Federal Law No. 15 of 2020 on Consumer Protection, new Members who have not yet used any Membership benefits may cancel their Membership within forty-eight (48) hours of the Commencement Date for a full refund of any fees paid. This cooling-off right is extinguished immediately upon the Member’s first use of any Facility or service. To exercise the cooling-off right, the Member must provide written notice via email or in person at the Facility within the 48-hour window.
12. Auto-Renewal
12.1 Automatic Conversion to Month-to-Month
At the end of the 12-month Commitment Term, the Membership automatically converts to a month-to-month rolling membership at the then-prevailing monthly rate for Month-to-Month Memberships unless the Member provides at least thirty (30) calendar days’ written notice before the Commitment Term expiry date.
12.2 Reminder Notice
The Academy shall send a reminder notice to the Member’s registered email address at least thirty (30) calendar days before the Commitment Term expiry date, informing the Member of the upcoming automatic conversion to month-to-month terms and the then-prevailing month-to-month rate.
12.3 Rate Difference
The month-to-month rate may be higher than the Commitment Term rate. The Member shall be informed of the new rate in the reminder notice.
13. Late Cancellation and No-Show Policy
13.1 Cancellation Notice Requirement
Cancellations of booked practice or play sessions must be made at least twenty-four (24) hours in advance via the Academy’s online booking system or by contacting the Facility directly.
13.2 Late Cancellations and No-Shows for Coaching Sessions
Cancellations of coaching lessons made less than twenty-four (24) hours before the scheduled session, or failure to attend a scheduled coaching session (no-show), shall result in the session being forfeited. For Members with included monthly lessons (Tiers 3 and 4), the lesson credit shall be deducted from their monthly allowance. For Members with add-on lesson packs, the lesson shall be forfeited with no refund.
13.3 No-Shows for Practice/Play Bookings
Repeated no-shows for practice or play bookings (three (3) or more within a rolling 30-day period) may result in temporary booking restrictions imposed at the Academy’s sole discretion.
14. Damages, Liability, and Personal Belongings
14.1 Participation at Own Risk
Members participate in all Facility activities at their own risk. The Academy does not guarantee the safety of Members or their personal belongings.
14.2 Limitation of Liability for Injury
Subject to applicable UAE law, the Academy shall not be liable for personal injury to Members except where such injury is directly caused by the Academy’s negligence or wilful misconduct. Members assume all risks associated with the use of the Facility and participation in activities.
14.3 Member Responsibility for Damage
Members are responsible for any damage to Academy property, equipment, or facilities caused by them or their guests. The Member shall immediately notify the Academy of any damage and shall pay for all repairs or replacement costs.
14.4 Personal Belongings
The Academy is not responsible for loss, theft, or damage to personal belongings, including but not limited to: bags, wallets, phones, watches, or other valuables. Members should secure personal items or leave them at home.
14.5 Insurance Recommendation
Members are advised to obtain personal insurance coverage for injury, illness, or loss of personal property related to their Membership and use of the Facility.
14.6 Non-Exclusion of Statutory Liability
Nothing in these Terms excludes or limits the Academy’s liability for death or personal injury caused by negligence, or any other liability that cannot be excluded under the laws of the United Arab Emirates.
15. Behaviour and Conduct
15.1 Member and Guest Conduct
Members and their guests must behave respectfully toward all Academy staff, coaches, and other Members at all times. Conduct must comply with all applicable laws of the UAE.
15.2 Zero-Tolerance Policy
The Academy operates a zero-tolerance policy for:
- Abusive, aggressive, or threatening behaviour
- Harassment or discrimination based on protected characteristics
- Profanity or offensive language
- Disruptive or disrespectful behaviour
15.3 Disciplinary Action and Termination
Misconduct may result in immediate suspension of Facility access or immediate termination of the Membership without notice or refund. The Academy’s determination of misconduct is final and binding.
16. Force Majeure
16.1 Non-Liability for Force Majeure Events
Neither party shall be liable for failure to perform obligations under this Agreement due to circumstances beyond its reasonable control, including but not limited to: government orders, natural disasters, extreme weather events, pandemics, public health emergencies, facility closures mandated by authorities, or war.
16.2 Member Options for Extended Force Majeure
In the event of a Force Majeure event lasting more than thirty (30) consecutive calendar days, the Academy shall offer affected Members the option to:
- Pause their Membership without counting toward the annual pause allowance, or
- Terminate their Membership without penalty or Early Termination Fee
The Academy shall provide prompt notice of Force Majeure events and available Member options.
17. Intellectual Property
All coaching methodologies, training programs, proprietary content, graphics, and materials developed or used by the Academy remain the exclusive property of SwingFIT Academies. Members may not record, photograph, reproduce, distribute, or transmit any coaching sessions, training materials, or proprietary content without the prior written consent of the Academy. Any unauthorised use shall constitute a breach of this Agreement and may result in immediate termination without refund.
18. Data Protection and Privacy
18.1 Regulatory Framework
The Academy collects and processes personal data in accordance with UAE Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data (PDPL).
18.2 Data Collected
The Academy collects and processes the following personal data:
- Full name and identification details
- Contact details (email, phone number, home address)
- Payment information (card details, billing address)
- Booking and usage history
- Coaching records and progress notes
- Health and medical information (if voluntarily provided)
18.3 Data Usage
Personal data is processed for the following purposes:
- Membership administration and account management
- Billing and payment processing
- Delivery of coaching services
- Marketing communications and service updates
- Service improvement and quality assurance
18.4 Data Sharing
The Academy will not share personal data with third parties except as necessary for payment processing (including card processors), legal compliance, or with the Member’s prior written consent.
18.5 Member Rights
Members have the right to access, correct, update, or request deletion of their personal data by contacting the Academy in writing. Requests shall be processed in accordance with PDPL.
18.6 Privacy Policy
Full details regarding data protection, data retention, and Member privacy rights are set out in the Academy’s Privacy Policy, available at www.swingfitacademies.com/privacy or upon request.
19. Dispute Resolution
19.1 Good-Faith Negotiation
The parties shall first attempt to resolve any dispute arising from or relating to this Agreement through good-faith negotiation within thirty (30) calendar days of written notice of the dispute from one party to the other.
19.2 Mediation
If negotiation does not resolve the dispute, either party may refer the matter to mediation administered by a mutually agreed mediator in Dubai or the relevant emirate where the Academy operates. Mediation shall be conducted in English. The parties shall share mediation costs equally.
19.3 Litigation
If mediation does not resolve the dispute within sixty (60) calendar days of commencement, either party may commence legal proceedings in the courts of the relevant emirate where the Academy operates.
20. Limitation of Liability
To the maximum extent permitted by applicable law of the United Arab Emirates, the Academy’s total aggregate liability under or in connection with this Agreement, whether in contract, tort, negligence, or otherwise, shall not exceed the total Membership fees paid by the Member in the twelve (12) calendar months immediately preceding the event giving rise to the claim.
The Academy shall not be liable for any indirect, consequential, incidental, special, or punitive damages, even if the Academy has been advised of the possibility of such damages.
Nothing in these Terms limits or excludes liability that cannot be limited or excluded under the laws of the United Arab Emirates, including but not limited to liability for death, personal injury caused by negligence, or fraud.
21. General Provisions
21.1 Entire Agreement
These Terms and Service Agreement constitute the entire and exclusive agreement between the Member and the Academy regarding the Membership and supersede all prior agreements, understandings, and negotiations, whether written or oral.
21.2 Severability
If any provision of these Terms is found to be unenforceable, invalid, or illegal, that provision shall be severed, and the remaining provisions shall continue in full force and effect.
21.3 Amendment
The Academy may amend these Terms with thirty (30) calendar days’ written notice to the Member. Continued use of the Facility or Membership services after the effective date of amendments constitutes acceptance of the amended Terms. Material changes to financial terms (including fees or payment terms) shall not be applied retroactively to existing Commitment Terms.
21.4 Assignment
The Academy may assign or transfer this Agreement and its rights and obligations under it to any successor entity or third party. The Member may not assign, transfer, or delegate their rights or obligations under this Agreement without the prior written consent of the Academy.
21.5 Waiver
The failure of the Academy to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision, nor shall it affect the Academy’s right to enforce such provision at any future time.
21.6 Language
These Terms are drafted and executed in English. In the event any translation into another language is made, the English version shall prevail and control in all respects.
22. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates, specifically including the UAE Civil Code, the UAE Commercial Code, and Federal Law No. 15 of 2020 on Consumer Protection. The courts of the emirate in which the relevant Academy location operates (Dubai) shall have jurisdiction over all disputes.
23. Acceptance
By clicking the ‘I Agree’ checkbox during the online checkout process, by submitting payment, or by using any Academy facility or service, the Member hereby acknowledges that they have read, understood, and fully agree to be bound by these Membership Terms and Service Agreement in their entirety.
